General Contest Rules

Prize

Non-cash prizes are not redeemable for cash. WMMR reserves the right, in its sole discretion, to substitute any prize with one of equal or greater value. Winners may not request prize substitution. Prizes are non-transferable and may not be claimed or used by any person other than the winner. Unless otherwise stated in the specific contest rules, prizes will not be mailed under any circumstances. Winners must claim their prizes in person at the WMMR offices within 30 days after the end of the contest. Prize Pickup Hours: Monday through Friday from 9am to 5:30pm (excluding holidays. Also, the day before and after a holiday we sometimes close early, so check with the Promotion Department if you plan on coming in on a weekday before or after a holiday). Prizes not claimed within the stated period will be forfeited.

Eligibility

All entrants must be at least 18 years old and legal residents of the United States, living or working in the Philadelphia metro survey area (as defined by Arbitron). A winner will be disqualified if he/she or a member of his/her household has won a WMMR contest with a value over $50.00 within the previous 60 days or a Greater Media Philadelphia (WBEN-FM, WMGK, WMMR, WPEN) contest with a value of $1000 or more within the previous 365 days. Employees (including their immediate families and members of the same household) of Greater Media Philadelphia, its affiliates, promotion sponsors, advertising and promotional agencies who do business with WMMR or any of the promotion sponsors, and other radio stations in WMMR’s metro survey area are not eligible to participate in any contest presented by WMMR. The term “immediate family” includes spouses, siblings, parents and legal guardians, children and legal wards, grandparents, and grandchildren, including “in-laws.” Limit one entry per person; multiple entries will disqualify the entrant. Void where prohibited.

Release

By entering, all participants release and hold harmless the promotion sponsors, WMMR, Greater Boston Radio, Inc., and each of their respective parents, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability and any injuries, loss or damage of any kind arising from or in connection with this contest and any prize won. Winners (and their guests, if any) will be required to sign a form releasing WMMR and its affiliated companies from all liability in connection with the contest and the award and use of the prize before claiming the prize.

Disclaimer

WMMR undertakes no liability or responsibility, and makes no warranties, express or implied, with respect to the performance of the prize(s) awarded, for any failure to perform or negligent performance of any service provider, or for any other risk, incident or damage, direct or indirect, relating to or arising out of the contest, including (but not limited to) cancellations, postponements, delays or other scheduling changes; missed events or connections or inability of winner to attend; and accident, injury, death, damage or expense arising from or occurring during the use of the prize, or travel to/from or attendance at any event relating to the contest, by the winner and/or winner’s guest(s). WMMR is not responsible for damage to a prize or loss of a prize after the prize has been claimed. Winners must inspect their prizes before leaving the station. WMMR is not responsible for technical, hardware or software failure or malfunctions, lost or unavailable network or other telecommunications connections, or lost, late, misdirected, damaged, illegible, inaccurate, incomplete, garbled, disconnected, or delayed contest entries or communications, whether caused by the sender or by any of the equipment or programming associated with or used in this contest, or by any human error which may occur in the execution of this contest. If, for any reason, the contest is not capable of being conducted as planned, including but not limited to infection by computer virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond the control of WMMR, Station management reserves the right at its sole discretion to cancel, terminate, modify or suspend the contest and/or determine an alternate method of awarding the prize(s).

License

Entry into any contest constitutes full permission for WMMR and promotion sponsors and their respective affiliates to broadcast and/or to photograph or publish the participant's name, voice, recorded comments, biographical information, face and likeness, in any medium, without compensation.

Taxes

If required by applicable law, WMMR will report the total value of each prize to the IRS and will furnish winners with a federal Form 1099. Winners must provide their social security number to WMMR for tax reporting purposes, and are solely responsible for payment of all taxes incurred as a result of the award of a prize.

General

Failure to conform to all contest rules, or any fraud or other illegal or inappropriate conduct on the part of a contestant or on a contestant’s behalf, will result in the contestant's disqualification and forfeiture of any prize won. WMMR reserves the right to rule ineligible listeners who, in WMMR’s sole judgment, engage in abusive conduct with respect to any contest or promotion conducted by WMMR or its affiliates. WMMR reserves the right to cancel, suspend and/or modify this Contest and these Official Rules at any time, which changes will become effective upon announcement. By taking part in this contest, participants agree to be bound by these rules and all decisions of the judges, who are employees of WMMR and whose decisions with respect to all aspects of the contest are final and binding. Copies of written contest rules and, where required by law, the list of winners are available during regular business hours at the WMMR studio, One Bala Plaza, Suite 424, Bala Cynwyd, PA 19004, for 60 days after the contest concludes.

As a condition to participating in this Contest, each entrant agrees that any and all disputes that cannot be resolved between the parties, and all causes of action arising out of or in connection with this Contest shall be resolved individually, without resort to any form of class action, exclusively before a court located in Philadelphia, Pennsylvania, having competent jurisdiction, which court shall apply the laws of the Commonwealth of Pennsylvania, without regard to the conflicts of law principles thereof. The entrant and WMMR hereby waive any and all right to trial by jury. If any provision of these Official Rules is declared or found by a court of competent jurisdiction to be illegal, unenforceable or void, then such provision will be null and void but each other provision hereof not so affected will be enforced to the full extent permitted by applicable law.

On-air/call-to-win

Online listeners to the WMMR web stream may experience a reception delay of up to one minute. Listening to the station’s over-the-air broadcast is the best way to participate in our on-air contests. Winner qualification is subject to FULL phone call completion, and the verification of the caller’s name, address, home phone number, work/cell phone number and social security number, all of which must be provided prior to completion of the call. Contest calls will not be accepted at any other number.

Text-to-win contests

For WMMR, the text short code is 39333, texting contests in which the listener must be a certain number texter to win (e.g., the 100th person to text in), unless otherwise noted, the correct texter must answer their mobile phone when called or another winner will be selected. For all texting contests, standard texting charges by your mobile phone carrier will apply. For all WMMR contests that permit listeners to enter by texting the station, listeners will also have the option to enter online at the following URL: www.vibescm.com/amoe. Unless the rules state otherwise, contest entries are limited to one per person for the entire contest, regardless of the entry method. Listeners who enter online will be required to provide the WMMR short code (39333), the contest keyword associated with the specific contest (or the one announced on air by the WMMR DJ, which may vary per contest), and the entrant's first and last name and phone number. For security purposes, online entrants will be required to enter the code word(s) shown on the entry page before completing their entry. All web and text entries will be pooled together and a winner(s) will be chosen from that pool in accordance with the contest rules.

Song of the Day contests

Only the specific Song of the Day, when played in its entirety from beginning to end, will be used to solicit contest calls. Snippets of songs played for advertising or promotional purposes and music beds that contain music from the Song of the Day WILL NOT count. Listeners should try to be the Xth caller at 215-263-WMMR (39333) as soon as they hear the Song of the Day begin to play. (If a listener accidentally calls when a song snippet or music bed is played, s/he will simply be informed of the error.)

 


WMMR’s Word of the Week Contest Rules

How to Enter for a Chance to Win:

Each weekday, WMMR’s Preston & Steve will announce the “Daily Letter” (a letter of the alphabet) near the end of their show, between 10am and 10:45am (times vary depending on the end time of that day’s show). On Friday of each week (or the last weekday on which Preston & Steve broadcast live that week, in the event of a holiday or vacation), listeners will be encouraged to call 215-263-WMMR (9667) after that day’s “Daily Letter”. The first Randomly selected caller to correctly identify the “Word of the Week” created by each of that week’s “Daily Letters” will be the winner of that week’s prize.

WMMR’s Preston & Steve’s Philly’s Hottest - Official Contest Rules

How to Enter and Win

Listeners will have the opportunity to enter by visiting WMMR.com/Contests and clicking on the Preston & Steve Philly’s Hottest contest link. Contest Periods will take place at different times throughout the year. Listen to 93.3 WMMR or visit our website at www.wmmr.com for details. Each entrant may submit up to 5 digital photos of themselves per contest, which must be submitted online in conjunction with completing the online entry form. Deadlines for submissions will be announced during weekday mornings on the Preston & Steve Show, or call MMR Promotions at 610-771-0933 for details. All entries must be received by the stated deadline to be eligible for consideration for that particular contest. Photos must be in .jpg format, with a maximum file size of 10MB. WMMR judges will select the official contestants in their sole discretion from the eligible entries received. If chosen as an official contestant, the entrant’s submitted photo(s) will be posted and voted upon at WMMR.com. WMMR Judges will determine the winner in conjunction with the votes cast (vote totals will be taken into account but may not be determinative of the winner). By entering the contest, you (1) certify that you hold all rights necessary to submit the photo(s) to WMMR for posting and promotional use as described in these rules, and (2) grant WMMR a perpetual, royalty-free license to post or publish your submitted photo(s) online and in any other media and to use the photo(s) for promotional purposes.

IMPORTANT NOTE: WMMR reserves the right to reject photos in its sole discretion. All submissions should be in good taste and may not depict actual or simulated sexual acts or nudity. Photos displaying full or partial nudity, “crotch” shots, or any image that focuses on the pelvic area will be rejected.

Prize

For each individual “Preston and Steve’s Hottest” contest, the following prizes will be awarded. Prize list will be updated from time to time and/or described on-air and at wmmr.com/shows/preston-and-steve/ for specific contests. Prizes may vary somewhat by “hottest” category; listen to 93.3 WMMR or visit our website at www.wmmr.com for additional prize details, if applicable.

One (1) prize will be awarded for each “hottest” contest/category, consisting of: $1,000 (total value) in prizes and gift certificates from Steven Singer Jewelers, a professional photo shoot and other prizes that are added from time to time when a new category is announced. Photos taken at the professional photo shoot that is part of the winner’s prize will become the sole property of WMMR. WMMR will provide paper and/or digital copies of the photos for the winner to use at her discretion, but the winner will not have any approval rights with respect to WMMR’s use of the photos. By accepting the prize, all winners grant WMMR irrevocable permission to use and display their image, as displayed in the professional photos, online and in other media, including on WMMR social media pages, and for other promotional purposes in WMMR’s sole discretion.

Estimated Retail Value: $2,000 (exact value depends on the specific prizes awarded)

Winners will be required to complete a Liability/Publicity Release Form at the time of pick up and must present valid photo ID. Some prizes take extra time to get into the station.

Pella Ticket Window – Official Contest Rules

NO PURCHASE OR OTHER CONSIDERATION IS NECESSARY TO PARTICIPATE IN THIS CONTEST; PURCHASE DOES NOT INCREASE CHANCES OF WINNING.

Contest Dates

This Contest will run for five (5) periods of two (2) weeks each in 2016: March 14th – 27th; May 2nd - 15th; June 20th - July 3rd; October 3rd - 16th; and October 24th – November 6th. Deadline to enter is 11:59pm (ET) on the last day (the second Sunday) of each contest period.

How to Enter or Participate for a Chance to Win

During each contest period, enter by clicking on the Pella Ticket Window contest link at www.wmmr.com/contests/ or www.wmgk.com/contests/, and then following the link to the Pella Ticket Window Contest Entry Page and the online entry form on that page. Entrants must complete and submit the online entry form. Incomplete submissions will not be eligible. Limit one online entry per person and per email address during each two-week contest period.

All contest entries will become the property of WMMR/WMGK and Pella Widows and will not be acknowledged or returned.

Winner Selection

Three (3) winners will be selected randomly at the end of each contest period, from all entries received during that contest period, and notified by phone or email. Winner selection is subject to confirmation of eligibility. Initially-selected winner(s) must confirm acceptance of prize within two (2) business days of initial winner notification. Failure to do so may result in disqualification and selection of a new winner. There will be fifteen (15) total winners for the entire contest.

Prize

Fifteen (15) Prizes (total) will be awarded, each consisting of: a pair of tickets to a Philadelphia area rock concert, sports event, or other entertainment event in 2016 or early 2017. Specific concert or event to be determined by WMMR/WMGK in their sole discretion during or upon completion of each contest period. Visit the Pella Ticket Window contest for periodic prize updates.

ERV: varies per concert/event, but will be approximately $60 to $200 per prize.

DESCRIPTION: The Beasley Media Group Spring 2017 Nationwide Contest (“Promotion”) begins on Monday, April 3, 2017, and will run through Friday, May 5, 2017.  The Promotion is being conducted by Beasley Media Group Inc. and its participating radio stations (the “Stations”) as listed below.  The Promotion, known as “The 1K Giveaway” on the Stations, will begin on Monday, April 3, 2017, and will run through Friday, May 5, 2017, excluding Friday, April 14, 2017, weekdays between the hours of 5am Pacific Time (“PT”) / 8am Eastern Time (“ET”) and 3:20pm PT / 6:20pm ET (“Promotion Period”).

ELIGIBILITY: The Promotion is open only to legal residents of the fifty (50) United States and District of Columbia (U.S.) who are at least eighteen (18) years of age or the age of majority in their state of residence, whichever is older as of date of entry (“Contestant”). Contestants will be competing with listeners from approximately fifty two (52) radio stations in multiple radio markets across the United States.  Employees, directors and officers and their immediate families (spouses and siblings, parents and children and their spouses) and household members of Beasley Media Group, Hipcricket Corporate, Clip Interactive, JacApps and Promotion sponsors (if any), and their respective parent companies, subsidiaries, distributors, affiliates, service providers, advertising and promotion agencies and companies involved in the design, implementation and execution of the Promotion (collectively the “Promotion Entities”), other radio stations in the metropolitan areas of the participating stations and members of their immediate families (parents, children, siblings, spouses) or persons living in the same households as such persons, whether related or not, are not eligible to participate or win. This Promotion is governed by Florida law and is subject to all federal, state and local laws and regulations.  Promotion is void in Puerto Rico, and US Territories and jurisdictions (including overseas military installations) and where prohibited.  Contestants are required to provide truthful information and Beasley Media will reject and delete any entry that it discovers to be false or fraudulent.  Beasley Media will disqualify any entry from individuals who do not meet the eligibility requirements and will also delete any entry as required by law.
  5. AGREEMENT TO THE OFFICIAL RULES: By participating in the Promotion, each participant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Administrator, which are final and binding in all matters related to the Promotion. Winning the prize is contingent upon fulfilling all requirements set forth herein.
  6. HOW TO ENTER: There are two (2) ways to enter.  Contestants may enter online or via text entry as follows:
    1. To participate in the Promotion, Beasley Media Group station listeners will need to listen to a participating Station each weekday during the Promotion Period at 8am, 11am, 1pm, 4pm, 6pm eastern time or 5am, 8am, 10am, 1pm, 3pm pacific, when at each time a Cue will be announced. The Cue will include a unique Key Word.  Upon hearing the Cue, enter by texting the Key Word to 40772 on a mobile phone or by entering online no later than fifteen (15) minutes after the start of the hour during which the Cue is announced to be entered for a chance to win a $1,000 cash prize.
    2. On each weekday throughout the Promotion, five (5) potential nationwide prize winners will be randomly selected – (i) one (1) between the hours of 5:00 a.m. PT / 8:00 a.m. ET and 5:15 a.m. PT / 8:15 a.m. ET. (ii) one (1) between the hours of 8:00 a.m. PT / 11:00 a.m. ET and 8:15 a.m. PT / 11:15 a.m. ET.  (iii) one (1) between the hours of 10:00 a.m. PT / 1:00 p.m. ET and 10:15 a.m. PT / 1:15 p.m.  (iv) one (1) between the hours of 1:00 p.m. PT / 4:00 p.m. ET and 1:15 p.m. PT / 4:15 p.m. ET.  (v) one (1) between the hours of 3 p.m. PT / 6:00 p.m. ET and 3:15 p.m. PT / 6:15 p.m. ET.  A total of one hundred twenty (120) Prizes will be awarded during the Promotion Period.  Beasley Media Group participating stations may also announce exact times that future Cues will be played.  Station listeners will be entering along with listeners from other stations around the country who will also receive the Key Word announcements at similar times and will be entering before the same Entry Period deadline for each Cue.
    3. Each entry window shall close at the start of the fifteenth (15th) minute after the top of the hour in which the Cue is announced, regardless of when the Cue airs (each, an “Entry Period”). Each participating station reserves the right to announce the Cue between the first one (1) and fifteen (15) minutes of the hour.  Following each Entry Period, Beasley Media will conduct a random drawing from among all mobile phone and online entrants who provided the correct Key Word nationwide during that Entry Period (the “Entry Period Pool”), and one (1) potential nationwide $1,000 cash prize winner will be randomly selected and called by Beasley Media promptly following his/her selection.  Only one (1) entry per person, per Cue is permitted regardless of the method of entry.  The randomly selected Contestant must be available at the time of Beasley Media’s call to be eligible to win the prize.  Once reached by phone, the randomly selected Contestant will be deemed the potential $1,000 cash prize winner (upon confirmation of eligibility).  At the time of the call, the potential prize winner will be required to provide all information requested to verify eligibility.  Information requested includes their full name, complete address (including zip code), day and evening phone numbers and date of birth.  Beasley Media will attempt to call the randomly selected entrant five (5) times shortly following the random drawing for the applicable Entry Period.  No voicemail message will be left.  If the potential prize winner fails to answer the calls or is disconnected or is otherwise found to be ineligible, the prize will be forfeited and the Station will randomly select another entrant from the same Entry Period Pool to be the potential $1,000 prize winner.  This will continue until the $1,000 prize is awarded in that hour (time permitting).  By participating in the Promotion entrants consent to Beasley Media contacting them by phone at the telephone number from which the mobile entry was received or as indicated by the entrant on the online entry form.  Any and all fees arising out of the transmission of or receipt of a mobile call shall solely be the responsibility of the entrant.  Message and data rates may apply per the entrant’s carrier.  By participating in the Promotion via mobile entry, entrants acknowledge that text messages are connected and transmitted through third party providers; Beasley Media does not guarantee, and shall not be responsible for, the connection or timeliness of any such text messages.
    4. To enter via Mobile Phone/Device: To enter by mobile phone, upon hearing the Cue, text the day’s Key Word to 40772 during the Cue’s Entry Period.  Message and data rates may apply.  Promotion Entities are not responsible for any fees or charges incurred for and associated with mobile entries.  The text message entry method is designed to work with most of the major wireless carriers in the United States, but the Promotion Entities make no guarantee that any particular wireless service provider will participate.  Entrants should check their phone’s features to see if they have that capability.  Entrants should consult their wireless service provider’s pricing plan for details.  Entry by text message will not improve your chance of winning.  By entering via text, each entrant consents to receive up to five (5) notification phone calls on their provided phone number if randomly selected as a potential winner.  Further, by entering by text message, entrants agree to accept all applicable charges associated therewith.
    5. To enter via Online Entry: To enter online, upon hearing the Cue visit the Station’s website and follow the links and instructions to enter the Promotion and complete and submit the online entry form during the respective Entry Period following the Cue.  By entering online, each entrant consents to receive up to five (5) notification phone calls on their provided phone number if randomly selected as a potential winner.  Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry.  The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning an email address or the domain associated with the submitted email address.  Multiple participants are not permitted to share the same email address.  Online entries submitted may not be acknowledged or returned.
    6. Entrants may enter only once per Entry Period, regardless of the method of entry (i.e., only one (1) entry per person per Cue). Additional entries will be disqualified by the Promotion Entities solely at their discretion.  A listener may only win one $1,000 cash prize during the Promotion, and only one $1,000 cash prize winner per household is permitted during the Promotion Period.  For this Promotion only, restrictions that would prevent a listener from winning if he/she had won another recent Beasley Media station contest or promotion will not apply.  Use of any device to automate entry is prohibited.  Proof of submission of an entry shall not be deemed proof of receipt by Beasley Media.  Beasley Media’s computer is the official time keeping device for the Promotion.  Any attempt by any Contestant to obtain more than the stated number of entries by using multiple/different identities, registrations or any other methods will void that participant’s entries and that Contestant may be disqualified.
    7. In the event of an equipment malfunction, Beasley Media reserves the right to award prize to a randomly selected entrant from the immediately prior Entry Period pool, except that any such Contestant who was awarded the prize for such Entry Period will be excluded. Given the volume of participation, Contestants may experience an inability to access website to enter.
    8. Online listeners to streamed broadcasts may experience a lag in transmissions due to buffering limitations. Entrants should not rely on streamed broadcasts to participate in any contest as they may be disadvantaged when participating in on-air contests. Entrants are encouraged to listen to the Station for the Cues on-air.  The Promotion Entities are not responsible for online streaming delays or outages.

PRIZES:  No more than the advertised number of prizes shall be awarded.  A prize may not be sold, traded, or commissioned, and is not exchangeable, transferable, or redeemable for cash except in the Promotion Entities’ sole discretion.  Prize details and availability are subject to change.  There are no substitutions unless specified by Beasley Media and Beasley Media reserves the right to substitute any prize (or prize component) with another prize (or prize component) of equal or greater value at its sole discretion.  Prizing may be fulfilled by a third party fulfillment company.  The Promotion Entities are not in any way responsible or liable for damages resulting from shipping and handling, loss, use or misuse of any prize awarded in this contest.  The prize is awarded if properly claimed according to the Rules and if there are sufficient eligible entries.  All other costs and expenses related to prize acceptance and use not specified herein as being provided are the sole responsibility of winner(s).  If the winner is disqualified or is found to be ineligible for the contest, Beasley Media reserves the right to determine an alternate winner or not to award the prize, at its sole discretion.  The prize(s) that may be awarded to the eligible winner(s) is a $1,000 cash prize and will be awarded as a check in the amount of $1,000 payable to the prize winner upon confirmation of eligibility.  Up to one hundred twenty (120) $1,000 cash prizes will be awarded.  Total Approximate Retail Value of each prize in the Promotion is $120,000

  1. Each cash prize will be issued as a check payable to the order of the prize winner upon verification of eligibility and upon timely receipt of all completed prize winner paperwork. Checks will be processed and mailed within four to eight weeks upon verification of eligibility and receipt of all completed prize winner paperwork.  All taxes, including but not limited to, federal, state, and local taxes, and any other costs and expenses associated with the acceptance and use of a prize are solely the responsibility of the winner.  The prize winners will each be issued an IRS Form 1099 for the value of their respective prize(s).
  2. WINNER SELECTION: Potential $1,000 cash prize winners will be determined as described above and will be notified by telephone beginning approximately fifteen (15) minutes following each Entry Period.  Listeners from approximately fifty two (52) radio stations in multiple radio markets across the United States will be participating at the same time(s).  Odds of being selected as a $1,000 cash prize winner depend on the combined number of entries received from all markets.  Decisions of Beasley Media with respect to the Promotion are final.
  3. WINNER NOTIFICATION: Beasley Media may notify potential prize winners by telephone with follow up correspondence by email, U.S. Mail and/or courier. Winners must execute and return any required affidavit of eligibility and/or liability/publicity release within five (5) days of notification attempt or prize will be forfeited. If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and/or liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, the potential winner forfeits the prize.
  4. CONDITIONS
    1. By participating, Contestants agree to: (a) release Promotion Entities, their respective directors, officers, agents and employees (collectively, “Released Parties”) from any and all liability for any claims, costs, injuries, losses or damages of any kind caused by their participation, including the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use, or misuse of the prize; and (b) except where prohibited by law, consent to the use by Beasley Media, the Station, or any other participating station, or their designees or agents, of winner’s name, hometown, likeness, statements and other personally identifiable information for promotion, advertising and marketing purposes in any media throughout the world without additional consideration and consent or prior review.  To the extent not prohibited by law, winners also agree to provide Beasley Media with an interview, which may be used in connection with the Promotion.  Promotion Entities are not responsible for incorrect or inaccurate transcription of Entry information, or for any human or other error, late, lost, or misdirected mail, or any other error or malfunction related to or resulting from participation in this Promotion.  CAUTION:  ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE, TAMPER WITH THE ENTRY PROCESS, OR OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, PROMOTION ENTITIES RESERVE THE RIGHT TO COOPERATE IN THE PROSECUTION OF ANY SUCH INDIVIDUAL(S) AND TO PURSUE ALL REMEDIES TO THE FULLEST EXTENT PERMITTED BY LAW.  Failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.  If for any reason the Promotion is not able to be executed as planned (in whole or in part), due to computer virus, bugs, tampering, unauthorized intervention, fraud, action of entrants, technical failures, or any other causes which in the opinion of Administrator and/or Sponsor, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Promotion, Administrator and/or Sponsor reserves the right at their sole discretion to disqualify any suspect entry or Contestant and to cancel, terminate, modify or suspend the Promotion. In the event of any cancellation, termination or suspension, notice thereof will be posted at the stations website and/or the event(s) and determination of the prize winner will be made, from among all eligible, non-suspect entries received as of the date of the termination, cancellation or suspension, as Administrator and/or Sponsor determines in their sole discretion.  Entries not complying with all rules are subject to disqualification.
    2. Payments of all federal, state and local taxes are solely the responsibility of the winner. The winner will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station (or any other commonly owned stations in the Station’s market) in a calendar year with an aggregate value of $600 or more.  Failure to submit a completed Form W-9 or equivalent upon request will result in forfeiture of the prize.  Such winnings of $600 or more will be reported to the IRS.
    3. Participation in the Promotion and/or acceptance of prize constitutes entrant’s and/or winner’s agreement to release, discharge, and hold harmless HipCricket Corporation, Clip Interactive, JacApps, Beasley Media, the Promotion’s sponsor(s), the participating radio stations, their licensees, and each of their respective parent, subsidiary and affiliated entities, their advertising and promotional agencies, prize suppliers, and participating sponsors, and their respective officers, shareholders, directors, employees, agents and representatives and all of their successors and assigns from and against any and all claims or liability arising directly or indirectly from the prize and participation in the Promotion, including but not limited to any claims based on publicity rights, defamation, or invasion of privacy and prize delivery.
    4. Beasley Media’s failure to enforce any term of these Official Rules shall not constitute a waiver of this provision. If due to circumstances beyond the control of Beasley Media, including any force majeure event or other event of local or national importance, any segment of the Promotion is delayed, rescheduled, postponed or cancelled, Beasley Media reserves the right, but not the obligation, to cancel, terminate, suspend, or modify the Promotion and shall not be required to award a substitute prize. Further, the Released Parties are not responsible if any part of a Promotion prize that cannot be awarded due to acts of God, acts of war, natural disasters, weather, acts of terrorism, or other factors beyond the Released Parties’ control.
    5. Contestants understand, acknowledge and agree that the Released Parties shall not be liable for losses or injuries of any kind resulting from the rejection of an entry given Beasley Media’s belief that the contestant was abusing or tampering with the Promotion entry process in any manner or due to any technical malfunction of the telephone or network transmission line or any entries that are late, delayed, garbled, incomplete, misdirected, lost, corrupted or otherwise not in compliance with the rules or applicable law.
    6. The Released Parties are not responsible for: (i) typographical or other errors in the printing, the offering, or the administration of the Promotion or in the announcement of a prize; (ii) incorrect or inaccurate entry information, human error, failure, or omission; (iii) unauthorized human intervention; (iv) entries not received due to difficulty accessing the internet, service outage or delays, equipment malfunctions, disconnections, or other technological failures, dropped calls or interruptions; (v) misdirected, misdialed, incomplete, incorrect, or late mobile text or website entries; and (vi) any cancellations, delays, diversions, or substitutions or omissions whatsoever by any transportation providers or any other persons or entities providing any services to winner(s) including any results thereof such as changes in services or location necessitated by same.

CONTEST RULES

 

These rules apply to the MMR*B*Q 2017 MetroPCS Ticket Upgrade contest (“Contest”) being conducted by Beasley Media Group, Inc. d/b/a WMMR (“Station”). In addition, the General Contest Rules posted on the Station’s website may apply to this contest.

 

  1. HOW TO ENTER AND PLAY

 

  1. The Contest will take place Saturday, May 20, 2017 from 12noon until 5pm.

 

  1. To participate in the contest, you must send a text message to 39333 containing the KEYWORD found at the participating MetroPCS Sponsor Booth located inside the MMR*B*Q Concert Venue- BB&T Pavilion (1 Harbor Blvd., Camden, NJ 08103). The KEYWORD must be spelled correctly to qualify. Entrants will receive a bounce back message confirming their entry.   1. ELIGIBILITY RESTRICTIONS

 

  1. Contest is open to all MMR*B*Q Concert-goers who are 18 years of age or older and who are legal US residents and reside in the Philadelphia metro survey area (as defined by Nielsen Audio). Contestants must possess a valid, government-issued ID. Winner must show proof of residency to verify eligibility.

 

  1. Employees of the Station, its licensee, its parent corporation, their affiliated entities, affiliated advertising agencies, participating sponsors/promotional partners including MetroPCS, other radio stations in the Philadelphia metropolitan survey area (as defined by Nielsen Audio) and the members of their immediate families and households are ineligible to participate or win. The term “immediate family” includes spouses, siblings, parents and legal guardians, children and legal wards, grandparents, and grandchildren, including “in-laws.”

 

  1. Listeners are eligible to win a Station contest only once every sixty (60) days with a prize valued at $50 or more, or a Beasley Media Group Philadelphia (including WBEN-FM, WMGK, WMMR, WPEN) contest with a prize value of $1,000 or more within the previous 365 days. Only one winner per household (whether related or not) is permitted in any contest.

 

  1. PRIZES

 

  1. 1 total prize will be awarded, consisting of a pair of reserved (seats) tickets to MMR*B*Q Music Festival 2017, Saturday May 20, 2017 at BB&T Pavilion, 1 Harbour Blvd, Camden, NJ. And a new Samsung Galaxy S7 phone (no service). Retail Value: $598. Prize includes tickets only, and does not include transportation, parking or other expenses related to attending the event, all of which are the sole responsibility of the winner. Prize will be redeemed on site.

 

  1. Prize must be claimed at the WMMR Tent booth on site at the MMR*B*Q concert. Failure to claim prize by the specified time will result in forfeiture of the prize.

 

  1. Unless otherwise permitted by the Station, winner(s) must claim his or her prize in person, and a prize cannot be claimed by third parties on behalf of the winner. If a contest is open to entrants under the age of 18 and a winner is under the age of 18, a parent or legal guardian must claim the prize.

 

  1. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its arrival. Station is not responsible for the safe arrival of a prize or prize certificate.

 

  1. Prizes are not transferable. Prizes may not be substituted for or redeemed for cash, except in the sole discretion of Station or the prize provider.

 

  1. SELECTION OF WINNERS

 

  1. 1 winner will be selected.

 

  1. Winners will be selected at random from all eligible entries.

  1. Taxes and Liability: Payment of all federal, state and local taxes is the sole responsibility of the winner. Winners may be required to accurately complete and submit IRS Form W-9 to the Station as a condition of receiving a prize.

 

  1. By participating in the Contest, contestant agrees to have his or her name, voice, or likeness used in any advertising or broadcasting material relating to this contest, in any medium, without additional financial or other compensation.

 

  1. By participating in the contest, each participant hereby releases and agrees to indemnify and hold harmless the Station, its licensee, affiliates, subsidiaries, parent corporation and each of their officers, directors, shareholders, employees, advertising and PR agencies, sponsors, advertisers, promotional partners, agents, representatives, and their successors and assigns, and all others connected with them and the contest (collectively, “Released Parties”) from any and all liability, claims, actions and damages sustained or incurred by participation in the contest and the receipt and use of any prize awarded (if any) through such contest arising in any manner whatsoever.

 

  1. Contest winners (and their guests or travel companions, if any) may be required, in the Station’s sole discretion, to sign a liability release and a publicity release. A winner (or his/her parent or legal guardian if under the age of 18 years) must execute and return any required release as instructed by the Station or winner will be disqualified and the prize will be forfeited. An alternate winner may be chosen by random selection in the Station’s sole discretion. Pursuant to the liability release, winners agree to hold the Released Parties harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest. If any contestant (or his/her parent or legal guardian, if applicable) refuses to sign any required release, any and all prizes will be forfeited.

The Station will be excused from its obligation to conduct the contest if its performance is delayed or prevented due to causes beyond its control, including, but not limited to acts of God, public enemies, war, civil disorder, fire, flood, hurricanes, explosion, labor disputes or strikes, and any acts by any governmental authority.

 

  1. The Station, its licensee, affiliates, subsidiaries, parent corporation, sponsors, advertisers and promotional partners, and their assigns and successors are not responsible for failure to conduct or for alterations to the contest due to circumstances beyond the control of any such entity.

 

  1. Decisions of Station management with respect to the contest are final.

 

  1. The Station reserves the right to end any contest or amend these rules upon announcement on air and publication at www.wmmr.com.

 

  1. The Station reserves the right to make changes to the rules of the Contest, including the substitution of a prize or prizes of equivalent or greater value, which will become effective upon announcement.

 

  1. The Station is not responsible for any prizes or certificates lost or stolen after the winner has claimed them from the Station.

 

  1. Prizes are awarded “AS IS, WHERE IS” with no guarantees or warranties as to use, safety, or performance. Acceptance of a prize releases the Station, its sponsors, promotional partners and advertisers from all liability and claims concerning the prize, its delivery, and its use.

 

  1. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the Contest or in the announcement of a prize. The Station is not responsible for (i) lost, stolen, mutilated, misdirected, postage due, illegible, incomplete or late entries; (ii) telephone or mobile service outages, delays, busy signals, facsimile transmission errors, equipment malfunctions and any other technological difficulties that may prevent an individual from completing his/her telephone call or from sending a text message (if applicable, message and data rates may apply, and the Station is not responsible for any fees incurred by an entrant for this method of entry); or (iii) entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties or other technical difficulties.

 

  1. By participating in this Contest, contestants agree to be bound by these rules. Failure to comply with the Contest rules may result in a contestant’s disqualification, at the sole discretion of the Station.

 

  1. o. Contestants are required to provide truthful information as part of their entry and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from contestants who do not meet the eligibility requirements and the Station will also delete any online entry knowingly received from contestants under the age of 13 in compliance with the Children’s Online Privacy Protection Act.

 

  1. Any materials submitted become the property of the Station and will not be returned.

 

  1. No purchase is necessary. The contest is void where prohibited. Contests and promotions are subject to all applicable federal, state and local laws.

Copies of the written Contest rules and, if required by applicable law, a list of all winners are available for 60 days after the Contest concludes, during regular business hours at the main studio of the Station, One Bala Plaza, Suite 424, Bala Cynwyd, PA 19004, or by sending a self-addressed, stamped envelope to the Station.

 

  1. For register-to-win contests, the odds of winning depend on the number of eligible entries received.

 

For Texting contests:

By participating in the Contest, entrants understand, acknowledge and agree that no purchase is necessary to participate in any text-to-win contest or to subscribe to any text club, and that texts sent by the Station are sent using an automated telephone dialing system. By initiating a text message to the Station in this contest, participants also expressly consent to the receipt of a reply message confirming entry and notification via text if the entrant is selected as a winner. Participants also understand, acknowledge and agree that reply messages from the Station may contain advertising and marketing messages, which support this free service.

 

  1. Message and data rates may be charged by wireless carriers for text entries and Contest-related communications. The Station is not responsible for any fees incurred by participants for this method of entry.

Entrants to this contest do not provide detailed personal information at the time of entry given the limitations of the text message format, but must provide all requested information if selected as the winner(s), including first name and last name, complete postal address (street, city, state, and zip code), email address, telephone number, date of birth, social security number (if required by law and federal tax reporting requirements), and verification of identity (such as a valid government-issued ID).

 

  1. All entrants must follow the “call to action” entry instructions and submit any requested information. If an entrant changes his/her mind regarding subscription to a text club, he/she must text the word “STOP” to the designated short code upon receipt of the confirmation message. Entrants may opt-out of a text club at any time.

 

  1. Text message and any mobile device entries will be deemed made by the authorized account holder of the mobile account submitted at the time of entry. The authorized account holder is the natural person who is assigned to the text or mobile telephone number by a telecommunications provider, or other organization that is responsible for assigning such numbers. Only text messages individually generated by wireless devices such as cellular or smart telephones and blackberries will be accepted; use of any device to automate entry is prohibited and will be cause for disqualification. Proof of submission of an entry from the entrant shall not be deemed proof of receipt by the Station. The contest administrator’s telephone system or text platform is the official time keeping device for the contest.

The Station is not responsible for any lost connections, miscommunications, failed computer or telephone transmissions, equipment or other technical failure, service interruptions, carrier or server delays or failures. The Station is not responsible for mis-sent, misdirected, or undeliverable text entries, and votes cannot be recalled once sent.

 

For contests with online entry submission:

 

  1. The Station is not responsible for entries not received due to difficulty accessing the Internet, service outages or delays, computer difficulties or other technological glitches.

 

  1. Contest participants using the Internet must provide a valid email address.

 

  1. The Station and sponsors are not responsible for technical, hardware, software or telephone or other transmission failures of any kind; lost or unavailable network connections; or incomplete, garbled or delayed computer transmissions whether caused by the Station, users, by any equipment or programming utilized in promotions, games or contests, or by human error which may occur in the processing of submissions, which may limit a participant’s ability to participate.

The Station reserves the right, in its sole discretion, to cancel or suspend a promotion, game or contest should a virus, bug, computer or other problem beyond the control of the Station corrupt the administration, security or proper execution of game or contest. The Station, in its sole discretion, may award prizes to entries received by alternate means.  All Internet participants agree to be bound by the specific contest rules, and the General Contest Rules appearing above.

To enter online, you must enter your first name and last name, complete address, city, state, zip code, home telephone number and a valid email address in the online entry form, as well as any other required information. Limit one Internet entry per person and one Internet entry per email address. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry.  The authorized account holder is the natural person who is assigned to the email address by an Internet access provider, online service provider, or other organization that is responsible by assigning email addresses or the domain associated with the submitted email address.

The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the Station website or who is otherwise in violation of the rules. The Station further reserves the right to cancel, terminate or modify the contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.
