General Contest Rules

Prize

Non-cash prizes are not redeemable for cash. WMMR reserves the right, in its sole discretion, to substitute any prize with one of equal or greater value. Winners may not request prize substitution. Prizes are non-transferable and may not be claimed or used by any person other than the winner. Unless otherwise stated in the specific contest rules, prizes will not be mailed under any circumstances. Winners must claim their prizes in person at the WMMR offices within 30 days after the end of the contest. Prize Pickup Hours: Monday through Friday from 9am to 5:30pm (excluding holidays. Also, the day before and after a holiday we sometimes close early, so check with the Promotion Department if you plan on coming in on a weekday before or after a holiday). Prizes not claimed within the stated period will be forfeited.

Eligibility

All entrants must be at least 18 years old and legal residents of the United States, living or working in the Philadelphia metro survey area (as defined by Arbitron). A winner will be disqualified if he/she or a member of his/her household has won a WMMR contest with a value over $50.00 within the previous 60 days or a Greater Media Philadelphia (WBEN-FM, WMGK, WMMR, WPEN) contest with a value of $1000 or more within the previous 365 days. Employees (including their immediate families and members of the same household) of Greater Media Philadelphia, its affiliates, promotion sponsors, advertising and promotional agencies who do business with WMMR or any of the promotion sponsors, and other radio stations in WMMR’s metro survey area are not eligible to participate in any contest presented by WMMR. The term “immediate family” includes spouses, siblings, parents and legal guardians, children and legal wards, grandparents, and grandchildren, including “in-laws.” Limit one entry per person; multiple entries will disqualify the entrant. Void where prohibited.

Release

By entering, all participants release and hold harmless the promotion sponsors, WMMR, Greater Boston Radio, Inc., and each of their respective parents, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability and any injuries, loss or damage of any kind arising from or in connection with this contest and any prize won. Winners (and their guests, if any) will be required to sign a form releasing WMMR and its affiliated companies from all liability in connection with the contest and the award and use of the prize before claiming the prize.

Disclaimer

WMMR undertakes no liability or responsibility, and makes no warranties, express or implied, with respect to the performance of the prize(s) awarded, for any failure to perform or negligent performance of any service provider, or for any other risk, incident or damage, direct or indirect, relating to or arising out of the contest, including (but not limited to) cancellations, postponements, delays or other scheduling changes; missed events or connections or inability of winner to attend; and accident, injury, death, damage or expense arising from or occurring during the use of the prize, or travel to/from or attendance at any event relating to the contest, by the winner and/or winner’s guest(s). WMMR is not responsible for damage to a prize or loss of a prize after the prize has been claimed. Winners must inspect their prizes before leaving the station. WMMR is not responsible for technical, hardware or software failure or malfunctions, lost or unavailable network or other telecommunications connections, or lost, late, misdirected, damaged, illegible, inaccurate, incomplete, garbled, disconnected, or delayed contest entries or communications, whether caused by the sender or by any of the equipment or programming associated with or used in this contest, or by any human error which may occur in the execution of this contest. If, for any reason, the contest is not capable of being conducted as planned, including but not limited to infection by computer virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond the control of WMMR, Station management reserves the right at its sole discretion to cancel, terminate, modify or suspend the contest and/or determine an alternate method of awarding the prize(s).

License

Entry into any contest constitutes full permission for WMMR and promotion sponsors and their respective affiliates to broadcast and/or to photograph or publish the participant's name, voice, recorded comments, biographical information, face and likeness, in any medium, without compensation.

Taxes

If required by applicable law, WMMR will report the total value of each prize to the IRS and will furnish winners with a federal Form 1099. Winners must provide their social security number to WMMR for tax reporting purposes, and are solely responsible for payment of all taxes incurred as a result of the award of a prize.

General

Failure to conform to all contest rules, or any fraud or other illegal or inappropriate conduct on the part of a contestant or on a contestant’s behalf, will result in the contestant's disqualification and forfeiture of any prize won. WMMR reserves the right to rule ineligible listeners who, in WMMR’s sole judgment, engage in abusive conduct with respect to any contest or promotion conducted by WMMR or its affiliates. WMMR reserves the right to cancel, suspend and/or modify this Contest and these Official Rules at any time, which changes will become effective upon announcement. By taking part in this contest, participants agree to be bound by these rules and all decisions of the judges, who are employees of WMMR and whose decisions with respect to all aspects of the contest are final and binding. Copies of written contest rules and, where required by law, the list of winners are available during regular business hours at the WMMR studio, One Bala Plaza, Suite 424, Bala Cynwyd, PA 19004, for 60 days after the contest concludes.

As a condition to participating in this Contest, each entrant agrees that any and all disputes that cannot be resolved between the parties, and all causes of action arising out of or in connection with this Contest shall be resolved individually, without resort to any form of class action, exclusively before a court located in Philadelphia, Pennsylvania, having competent jurisdiction, which court shall apply the laws of the Commonwealth of Pennsylvania, without regard to the conflicts of law principles thereof. The entrant and WMMR hereby waive any and all right to trial by jury. If any provision of these Official Rules is declared or found by a court of competent jurisdiction to be illegal, unenforceable or void, then such provision will be null and void but each other provision hereof not so affected will be enforced to the full extent permitted by applicable law.

On-air/call-to-win

Online listeners to the WMMR web stream may experience a reception delay of up to one minute. Listening to the station’s over-the-air broadcast is the best way to participate in our on-air contests. Winner qualification is subject to FULL phone call completion, and the verification of the caller’s name, address, home phone number, work/cell phone number and social security number, all of which must be provided prior to completion of the call. Contest calls will not be accepted at any other number.

Text-to-win contests

For WMMR, the text short code is 39333, texting contests in which the listener must be a certain number texter to win (e.g., the 100th person to text in), unless otherwise noted, the correct texter must answer their mobile phone when called or another winner will be selected. For all texting contests, standard texting charges by your mobile phone carrier will apply. For all WMMR contests that permit listeners to enter by texting the station, listeners will also have the option to enter online at the following URL: www.vibescm.com/amoe. Unless the rules state otherwise, contest entries are limited to one per person for the entire contest, regardless of the entry method. Listeners who enter online will be required to provide the WMMR short code (39333), the contest keyword associated with the specific contest (or the one announced on air by the WMMR DJ, which may vary per contest), and the entrant's first and last name and phone number. For security purposes, online entrants will be required to enter the code word(s) shown on the entry page before completing their entry. All web and text entries will be pooled together and a winner(s) will be chosen from that pool in accordance with the contest rules.

Song of the Day contests

Only the specific Song of the Day, when played in its entirety from beginning to end, will be used to solicit contest calls. Snippets of songs played for advertising or promotional purposes and music beds that contain music from the Song of the Day WILL NOT count. Listeners should try to be the Xth caller at 215-263-WMMR (39333) as soon as they hear the Song of the Day begin to play. (If a listener accidentally calls when a song snippet or music bed is played, s/he will simply be informed of the error.)

 


WMMR’s Word of the Week Contest Rules

How to Enter for a Chance to Win:

Each weekday, WMMR’s Preston & Steve will announce the “Daily Letter” (a letter of the alphabet) near the end of their show, between 10am and 10:45am (times vary depending on the end time of that day’s show). On Friday of each week (or the last weekday on which Preston & Steve broadcast live that week, in the event of a holiday or vacation), listeners will be encouraged to call 215-263-WMMR (9667) after that day’s “Daily Letter”. The first Randomly selected caller to correctly identify the “Word of the Week” created by each of that week’s “Daily Letters” will be the winner of that week’s prize.

WMMR’s Preston & Steve’s Philly’s Hottest - Official Contest Rules

How to Enter and Win

Listeners will have the opportunity to enter by visiting WMMR.com/Contests and clicking on the Preston & Steve Philly’s Hottest contest link. Contest Periods will take place at different times throughout the year. Listen to 93.3 WMMR or visit our website at www.wmmr.com for details. Each entrant may submit up to 5 digital photos of themselves per contest, which must be submitted online in conjunction with completing the online entry form. Deadlines for submissions will be announced during weekday mornings on the Preston & Steve Show, or call MMR Promotions at 610-771-0933 for details. All entries must be received by the stated deadline to be eligible for consideration for that particular contest. Photos must be in .jpg format, with a maximum file size of 10MB. WMMR judges will select the official contestants in their sole discretion from the eligible entries received. If chosen as an official contestant, the entrant’s submitted photo(s) will be posted and voted upon at WMMR.com. WMMR Judges will determine the winner in conjunction with the votes cast (vote totals will be taken into account but may not be determinative of the winner). By entering the contest, you (1) certify that you hold all rights necessary to submit the photo(s) to WMMR for posting and promotional use as described in these rules, and (2) grant WMMR a perpetual, royalty-free license to post or publish your submitted photo(s) online and in any other media and to use the photo(s) for promotional purposes.

IMPORTANT NOTE: WMMR reserves the right to reject photos in its sole discretion. All submissions should be in good taste and may not depict actual or simulated sexual acts or nudity. Photos displaying full or partial nudity, “crotch” shots, or any image that focuses on the pelvic area will be rejected.

Prize

For each individual “Preston and Steve’s Hottest” contest, the following prizes will be awarded. Prize list will be updated from time to time and/or described on-air and at wmmr.com/shows/preston-and-steve/ for specific contests. Prizes may vary somewhat by “hottest” category; listen to 93.3 WMMR or visit our website at www.wmmr.com for additional prize details, if applicable.

One (1) prize will be awarded for each “hottest” contest/category, consisting of: $1,000 (total value) in prizes and gift certificates from Steven Singer Jewelers, a professional photo shoot and other prizes that are added from time to time when a new category is announced. Photos taken at the professional photo shoot that is part of the winner’s prize will become the sole property of WMMR. WMMR will provide paper and/or digital copies of the photos for the winner to use at her discretion, but the winner will not have any approval rights with respect to WMMR’s use of the photos. By accepting the prize, all winners grant WMMR irrevocable permission to use and display their image, as displayed in the professional photos, online and in other media, including on WMMR social media pages, and for other promotional purposes in WMMR’s sole discretion.

Estimated Retail Value: $2,000 (exact value depends on the specific prizes awarded)

Pella Ticket Window – Official Contest Rules

NO PURCHASE OR OTHER CONSIDERATION IS NECESSARY TO PARTICIPATE IN THIS CONTEST; PURCHASE DOES NOT INCREASE CHANCES OF WINNING.

Contest Dates

This Contest will run for five (5) periods of two (2) weeks each in 2016: March 14th – 27th; May 2nd - 15th; June 20th - July 3rd; October 3rd - 16th; and October 24th – November 6th. Deadline to enter is 11:59pm (ET) on the last day (the second Sunday) of each contest period.

How to Enter or Participate for a Chance to Win

During each contest period, enter by clicking on the Pella Ticket Window contest link at www.wmmr.com/contests/ or www.wmgk.com/contests/, and then following the link to the Pella Ticket Window Contest Entry Page and the online entry form on that page. Entrants must complete and submit the online entry form. Incomplete submissions will not be eligible. Limit one online entry per person and per email address during each two-week contest period.

All contest entries will become the property of WMMR/WMGK and Pella Widows and will not be acknowledged or returned.

Winner Selection

Three (3) winners will be selected randomly at the end of each contest period, from all entries received during that contest period, and notified by phone or email. Winner selection is subject to confirmation of eligibility. Initially-selected winner(s) must confirm acceptance of prize within two (2) business days of initial winner notification. Failure to do so may result in disqualification and selection of a new winner. There will be fifteen (15) total winners for the entire contest.

Prize

Fifteen (15) Prizes (total) will be awarded, each consisting of: a pair of tickets to a Philadelphia area rock concert, sports event, or other entertainment event in 2016 or early 2017. Specific concert or event to be determined by WMMR/WMGK in their sole discretion during or upon completion of each contest period. Visit the Pella Ticket Window contest for periodic prize updates.

ERV: varies per concert/event, but will be approximately $60 to $200 per prize.

Go to one or both of the WMMR radio station appearances at the Metro PCS locations listed below to obtain an official entry form from a member of the WMMR promotional staff  or at the entry box.  To submit an entry, complete the official entry form in its entirety, and place completed entry form in the official registration box.  Limit one entry per person, per location. WMMR reserves the right to disqualify any entry that is not complete and legible.

  • Appearance #1 will take place on Wednesday, October 26, 2016 from 4pm to 6pm at the Metro PCS store at 3817 Aramingo Avenue, Philadelphia, PA 19137.
  • Appearance #2 will take place on Friday, November 4, 2016 from 4pm to 6pm at the Metro PCS store at 1943 Street Road, Bensalem, PA 19020.

Every 10 minutes during each appearance, a name will be drawn out of the entry box and the contestant whose name is drawn will win a pair of tickets to the UFC 205 VIP Watch Party at XFINITY Live! Philadelphia on Saturday, November 12, 2016.  Contestants must be present to win.  If a contestant is not present in the Metro PCS store within 30 seconds after their name is drawn, s/he will be disqualified and either another name will be drawn immediately or the station staff may opt to hold the passes until a new name is drawn 10 minutes later.

Every 60 minutes during each appearance, a name will be drawn (after the Watch Party name is drawn for that 10 minute interval) out of the entry box and the contestant whose name is drawn will win a pair of tickets to UFC 205 at Madison Square Garden in New York City on Saturday, November 12, 2016.  Contestants must be present to win.  If a contestant is not present in the Metro PCS store within 30 seconds after their name is drawn, s/he will be disqualified and either another name will be drawn immediately or the station staff may opt to hold the passes until a new name is drawn 60 minutes later.

All entries will become the property of WMMR and Metro PCS, and will not be acknowledged or returned.

Prize

Four (4) First Prizes will be awarded, two at each MetroPCS store appearance, each consisting of two (2) tickets to UFC 205 at Madison Square Garden in New York, NY, on Saturday, November 12, 2016. Retail value: $160 per prize. Prize includes tickets only, and does not include transportation, parking or other expenses related to attending the event, all of which are the sole responsibility of the winner.

Twenty-Four (24) second prizes will be awarded, twelve (12) at each MetroPCS store appearance, each consisting of two (2) tickets to attend the VIP Watch Party at XFINITY Live! Philadelphia (1100 Pattison Ave, Philadelphia, PA) on Saturday, November 12, 2016.  VIP tickets include: entry into the venue and its VIP section, and limited food and beverage. Prize does NOT include parking or gratuity.  Retail value: $80.

Non-cash prizes are not redeemable for cash.  Station reserves the right, in its sole discretion, to substitute any prize or prize element with one of equal or greater value.  Winners may not request prize substitution.  Prizes are non-transferable and may not be claimed or used by any person other than the winner.  Winners must claim their prize by completing all required paperwork in person at the MetroPCS event at which they won.  Any Prize not claimed at that time will be forfeited.

Eligibility

All entrants must be at least 18 years old and legal residents of the United States, living or working in the Philadelphia metro survey area (as defined by Nielsen Audio).  WMMR’s 60 day and 365 Day rule are not in effect for this contest but the winner of this contest will not be eligible to win another WMMR contest for 60 days.  Employees (including their immediate families and members of the same household) of Greater Media Philadelphia, MetroPCS, their respective affiliates, any other promotion sponsors, advertising and promotional agencies who do business with WMMR or any of the promotion sponsors, and other radio stations in the Philadelphia metro survey area (as defined by Nielsen Audio) are not eligible to participate.  The term “immediate family” includes spouses, siblings, parents and legal guardians, children and legal wards, grandparents, and grandchildren, including “in-laws.”  Limit one entry per person per location; and limit of one prize (total) per person and household.  Void where prohibited.

Release

By participating, entrants agree to release and hold harmless MetroPCS, any other promotion sponsors/prize providers,  WMMR, Greater Boston Radio, Inc. and each of their respective parents, subsidiaries, affiliates, directors, officers, employees and agents (collectively, the “Released Parties”) from any and all liability and any injuries, loss or damage of any kind arising from or in connection with this contest and any prize won.  Winners will be required to sign a form releasing the Released Parties from all liability in connection with the contest and the award and use of the prize before claiming the prize.

Disclaimer

Each of the Released Parties undertakes no liability or responsibility, and makes no warranties, express or implied, with respect to the performance of the prize(s) awarded, for any failure to perform or negligent performance of any service provider, or for any other risk, incident or damage, direct or indirect, relating to or arising out of the contest, including (but not limited to) cancellations, postponements, delays or other scheduling changes; missed events or connections or inability of winner to attend; and accident, injury, death, damage or expense arising from or occurring during the use of the prize, or travel to/from or attendance at any event relating to the contest, by the winner and/or winner’s guest(s).  The Released Parties are not responsible for damage to a prize or loss of a prize after the prize has been claimed. Winners must inspect prize or prize certificates before leaving the appearance.  The Released Parties are not responsible for technical, hardware or software failure or malfunctions, lost or unavailable network or other telecommunications connections, or lost, late, damaged, illegible, inaccurate, incomplete, garbled, disconnected, or delayed contest entries or communications, whether caused by the sender or by any of the equipment or programming associated with or used in this contest, or by any human error which may occur in the execution of this contest.  If, for any reason, the contest is not capable of being conducted as planned, including but not limited to infection by computer virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond the control of the WMMR or MetroPCS, Station management reserves the right at its sole discretion to cancel, terminate, modify or suspend the contest and/or determine an alternate method of awarding the prize(s).

License

Entry into any contest constitutes full permission for WMMR and MetroPCS and their respective affiliates to broadcast and/or to photograph or publish the participant's name, voice, recorded comments, biographical information, face and likeness, in any medium, without compensation.

Taxes

If required by applicable law, WMMR will report the total value of each prize to the IRS and will furnish winners with a federal Form 1099.  Winners may be required to provide their social security number to WMMR for tax reporting purposes, and are solely responsible for payment of all taxes incurred as a result of the award of a prize.

General

Failure to conform to all contest rules, or any fraud or other illegal or inappropriate conduct on the part of a contestant or on a contestant’s behalf, will result in the contestant's disqualification and forfeiture of any prize won.  WMMR reserves the right to rule ineligible listeners who, in WMMR’s sole judgment, engage in abusive conduct with respect to any contest or promotion conducted by WMMR or its affiliates.  WMMR reserves the right to make changes in the contest rules at any time, which changes will become effective upon announcement.  By taking part in this contest, participants agree to be bound by these rules and all decisions of the judges, who are employees of WMMR and whose decisions with respect to all aspects of the contest are final and binding.  Copies of written contest rules and the list of winners are available during regular business hours at the WMMR studio, One Bala Plaza, Suite 424, Bala Cynwyd, PA 19004 for 60 days after the contest concludes.

As a condition to participating in this Contest, each entrant agrees that any and all disputes that cannot be resolved between the parties, and all causes of action arising out of or in connection with this Contest shall be resolved individually, without resort to any form of class action, exclusively before a court located in Philadelphia, Pennsylvania, having competent jurisdiction, which court shall apply the laws of the Commonwealth of Pennsylvania, without regard to the conflicts of law principles thereof. The entrant and Contest Entities hereby waive any and all right to trial by jury. If any provision of these Official Rules is declared or found by a court of competent jurisdiction to be illegal, unenforceable or void, then such provision will be null and void but each other provision hereof not so affected will be enforced to the full extent permitted by applicable law.

CONTEST RULES

These rules apply to the Preston & Steve Commercial Bowl contest (“Contest”) being conducted by Beasley Media Group, Inc. d/b/a WMMR (“Station”). In addition, the General Contest Rules posted on the Station’s website may apply to this contest.

1. HOW TO ENTER AND PLAY

a. The Contest will begin on Tuesday, January 24, 2017 and end at 11:59pm on Sunday, February 5, 2017.

b. To participate in the contest, listeners must create an original-concept radio commercial promoting The Preston & Steve Show on 93.3 WMMR, no longer than 30 seconds long. Entrants must upload their audio to YouTube and email a link to their submission to [email protected] and include their name, address, date of birth, day time phone number, and email address. One entry permitted per person.

2. ELIGIBILITY RESTRICTIONS

a. Contest is open to all Station listeners who are 18 years of age or older and who are legal US residents and reside in the Philadelphia metro survey area (as defined by Nielson Audio). Contestants must possess a valid, government-issued ID. Winner must show proof of residency to verify eligibility.

b. Employees of the Station, its licensee, its parent corporation, their affiliated entities, affiliated advertising agencies, participating sponsors/promotional partners, other radio stations in the Philadelphia metropolitan survey area (as defined by Nielsen Audio) and the members of their immediate families and households are ineligible to participate or win. The term “immediate family” includes spouses, siblings, parents and legal guardians, children and legal wards, grandparents, and grandchildren, including “in-laws.”

c. Listeners are eligible to win a Station contest only once every sixty (60) days with a prize valued at $50 or more, or a Beasley Media Group Philadelphia (including WBEN-FM, WMGK, WMMR, WPEN) contest with a prize value of $1,000 or more within the previous 365 days. Only one winner per household (whether related or not) is permitted in any contest.

3. PRIZES

a. One (1) prize will be awarded consisting of $1,000, payable via Company Check. Winners must provide their social security number and a completed IRS W-9 Form in order for WMMR to process the check. Please allow 4-6 weeks for check processing.

b. Unless otherwise specified, all prizes or prize certificates must be claimed at the office of the Station located at One Bala Plaza, Suite 424, Bala Cynwyd, PA 19004, Monday-Friday, during regular business hours (9am to 5:30pm) and excluding holidays. Prize or prize certificate must be claimed within 30 days of being notified that the check is ready for pick up. Failure to claim prize by the specified time will result in forfeiture of the prize.

c. Unless otherwise permitted by the Station, winner(s) must claim his or her prize in person, and a prize cannot be claimed by third parties on behalf of the winner. If a contest is open to entrants under the age of 18 and a winner is under the age of 18, a parent or legal guardian must claim the prize.

d. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its arrival. Station is not responsible for the safe arrival of a prize or prize certificate.

e. Prizes are not transferable. Prizes may not be substituted for or redeemed for cash, except in the sole discretion of Station or the prize provider.

4. SELECTION OF WINNERS

a. Ten (10) finalists will be selected between 11am on Wednesday, February 1, 2017 and 5pm on Thursday February 2, 2017. Those 10 finalists will be posted to a page at wmmr.com before 6am on Friday 2/3/2017. Listeners will be instructed to vote for their favorite submission. One Vote Per Person. The winner will be revealed on air during the Preston & Steve Show on Monday, February 6, 2017.

b. Finalists will be selected via a panel of WMMR judges in their sole discretion.

5. CONDITIONS

a. WARNING: Online listeners to streamed broadcasts may experience a lag in transmissions.

b. Taxes and Liability: Payment of all federal, state and local taxes is the sole responsibility of the winner. Contest winnings will be reported to the Internal Revenue Service and winners can expect to receive a 1099 tax form for prizes which total more than $600 for the calendar year. Winners may be required to accurately complete and submit IRS Form W-9 to the Station as a condition of receiving a prize.

c. By participating in the Contest, contestant agrees to have his or her name, voice, or likeness used in any advertising or broadcasting material relating to this contest, in any medium, without additional financial or other compensation.

d. By participating in the contest, each participant hereby releases and agrees to indemnify and hold harmless the Station, its licensee, affiliates, subsidiaries, parent corporation and each of their officers, directors, shareholders, employees, advertising and PR agencies, sponsors, advertisers, promotional partners, agents, representatives, and their successors and assigns, and all others connected with them and the contest (collectively, “Released Parties”) from any and all liability, claims, actions and damages sustained or incurred by participation in the contest and the receipt and use of any prize awarded (if any) through such contest arising in any manner whatsoever.

e. Contest winners (and their guests or travel companions, if any) may be required, in the Station’s sole discretion, to sign a liability release and a publicity release. A winner (or his/her parent or legal guardian if under the age of 18 years) must execute and return any required release as instructed by the Station or winner will be disqualified and the prize will be forfeited. An alternate winner may be chosen by random selection in the Station’s sole discretion. Pursuant to the liability release, winners agree to hold the Released Parties harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest. If any contestant (or his/her parent or legal guardian, if applicable) refuses to sign any required release, any and all prizes will be forfeited.

f. The Station will be excused from its obligation to conduct the contest if its performance is delayed or prevented due to causes beyond its control, including, but not limited to acts of God, public enemies, war, civil disorder, fire, flood, hurricanes, explosion, labor disputes or strikes, and any acts by any governmental authority.

g. The Station, its licensee, affiliates, subsidiaries, parent corporation, sponsors, advertisers and promotional partners, and their assigns and successors are not responsible for failure to conduct or for alterations to the contest due to circumstances beyond the control of any such entity.

h. Decisions of Station management with respect to the contest are final.

i. The Station reserves the right to end any contest or amend these rules upon announcement on air and publication at www.wmmr.com.

j. The Station reserves the right to make changes to the rules of the Contest, including the substitution of a prize or prizes of equivalent or greater value, which will become effective upon announcement.

k. The Station is not responsible for any prizes or certificates lost or stolen after the winner has claimed them from the Station.

l. Prizes are awarded “AS IS, WHERE IS” with no guarantees or warranties as to use, safety, or performance. Acceptance of a prize releases the Station, its sponsors, promotional partners and advertisers from all liability and claims concerning the prize, its delivery, and its use.

m. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the Contest or in the announcement of a prize. The Station is not responsible for (i) lost, stolen, mutilated, misdirected, postage due, illegible, incomplete or late entries; (ii) telephone or mobile service outages, delays, busy signals, facsimile transmission errors, equipment malfunctions and any other technological difficulties that may prevent an individual from completing his/her telephone call or from sending a text message (if applicable, message and data rates may apply, and the Station is not responsible for any fees incurred by an entrant for this method of entry); or (iii) entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties or other technical difficulties.

n. By participating in this Contest, contestants agree to be bound by these rules. Failure to comply with the Contest rules may result in a contestant’s disqualification, at the sole discretion of the Station.

o. Contestants are required to provide truthful information as part of their entry and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from contestants who do not meet the eligibility requirements and the Station will also delete any online entry knowingly received from contestants under the age of 13 in compliance with the Children’s Online Privacy Protection Act.

p. Any materials submitted become the property of the Station and will not be returned.

q. No purchase is necessary. The contest is void where prohibited. Contests and promotions are subject to all applicable federal, state and local laws.

r. By use of the Station’s website and by entering this Promotion, contestants agree to the Station’s Terms of Service Agreement and to the use of Personal Information as stated in the Privacy Policy located at www.wmmr.com.

s. Copies of the written Contest rules and, if required by applicable law, a list of all winners are available for 60 days after the Contest concludes, during regular business hours at the main studio of the Station, One Bala Plaza, Suite 424, Bala Cynwyd, PA 19004, or by sending a self-addressed, stamped envelope to the Station.

t. For register-to-win contests, the odds of winning depend on the number of eligible entries received.

FOR CONTESTS WITH ONLINE ENTRY SUBMISSION:

a. The Station is not responsible for entries not received due to difficulty accessing the Internet, service outages or delays, computer difficulties or other technological glitches.

b. Contest participants using the Internet must provide a valid email address.

c. The Station and sponsors are not responsible for technical, hardware, software or telephone or other transmission failures of any kind; lost or unavailable network connections; or incomplete, garbled or delayed computer transmissions whether caused by the Station, users, by any equipment or programming utilized in promotions, games or contests, or by human error which may occur in the processing of submissions, which may limit a participant’s ability to participate.

d. The Station reserves the right, in its sole discretion, to cancel or suspend a promotion, game or contest should a virus, bug, computer or other problem beyond the control of the Station corrupt the administration, security or proper execution of game or contest. The Station, in its sole discretion, may award prizes to entries received by alternate means. All Internet participants agree to be bound by the specific contest rules, and the General Contest Rules appearing above.

e. To enter online, you must enter your first name and last name, complete address, city, state, zip code, home telephone number and a valid email address in the online entry form, as well as any other required information. Limit one Internet entry per person and one Internet entry per email address. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an Internet access provider, online service provider, or other organization that is responsible by assigning email addresses or the domain associated with the submitted email address.

f. The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the Station website or who is otherwise in violation of the rules. The Station further reserves the right to cancel, terminate or modify the contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.

FOR ENTRIES THAT INCLUDE SUBMITTING AUDIO:

a. Profanity, obscenity and nudity are not permitted in video entries. The Station, at its sole discretion, reserves the right to disqualify and/or destroy any entry if or when it is discovered that such entry contains infringing, illegal, indecent or otherwise offensive material or if such entry contains material whose content is deemed at the sole discretion of the Station to be unsuitable for public viewing, performance or posting via the Internet.

b. Each contestant’s video entry must be his/her original creative work and/or property and must not contain copyrighted materials or any other materials, which may be restricted, prohibited, or outlawed by Federal, state or local laws. Contestants are required to obtain a written release from all individuals appearing in the video which grants, the right to use their name, likeness and recorded voice and the right to post the video on Station’s website for the general public to view. Each contestant agrees to hold the Released Parties harmless against any and all claims or liability arising directly or indirectly from the prize and/or contest, including but not limited to an infringement or alleged infringement of any intellectual property, publicity or privacy right, or violation of any law or regulation, involving the video entry.
